1. Acceptance of Terms

By accessing and using the maikers platform and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

maikers is a platform that connects creators and enables the development of digital experiences and realities. Our services include community features, creator tools, and collaborative platforms for building innovative digital experiences.

3. Agent-NFT Minting and Ownership

The maikers mainframe allows users to mint 'Agent-NFTs' on the Solana blockchain. By using this feature, you acknowledge and agree that:

  • Minting an Agent-NFT creates a permanent digital asset on the Solana blockchain.
  • You represent and warrant that you hold all necessary rights, licenses, and permissions to the underlying NFT collection used to create the Agent-NFT.
  • You are solely responsible for the content, metadata, and configuration of any Agent-NFT you create.
  • Maikers does not claim ownership of the underlying NFTs you use to create Agent-NFTs.

4. Protocol Fees and Payments

Use of the maikers mainframe protocol may incur fees. You agree to the following fee structure:

  • Protocol fees are payable in SOL (Solana native token) and are non-refundable once a transaction is processed on the blockchain.
  • Transaction fees (gas fees) are paid to the Solana network and are separate from protocol fees.
  • Holders of specific Maikers'collectibles NFTs may be eligible for fee waivers or discounts as determined by the protocol's current policy.
  • We reserve the right to adjust protocol fees at any time. Any fee changes will be displayed prior to transaction confirmation.

5. Wallet Management and Security

Non-Custodial Wallets

When using non-custodial wallets (e.g., Phantom, Solflare) to interact with our platform:

  • You are solely responsible for the security of your private keys and seed phrases.
  • Maikers has no access to your private keys and cannot recover your funds if you lose access to your wallet.
  • You are responsible for approving all transactions initiated through your wallet.

Custodial Services

If you utilize any custodial wallet management features provided by the platform:

  • We employ industry-standard security measures to protect custodial assets.
  • You acknowledge the inherent risks associated with digital asset custody, including but not limited to smart contract vulnerabilities and unauthorized access.
  • Maikers is not liable for losses resulting from user negligence, such as compromised account credentials.

6. Automation and AI Agent Accountability

The platform enables the creation and deployment of autonomous AI Agents. By deploying an Agent, you agree that:

  • You are ultimately responsible for all actions, decisions, and transactions initiated by your AI Agents.
  • You must monitor your Agents' activities and ensure they comply with all applicable laws and regulations.
  • Maikers provides the infrastructure for Agent execution but does not control or direct the specific actions of user-deployed Agents.
  • Maikers is not liable for any financial losses, reputational damage, or other harm caused by the autonomous behavior of your AI Agents.
  • We reserve the right to halt or terminate any Agent that violates our Acceptable Use Policy or poses a risk to the platform or other users.

7. User Accounts and Platform Requirements

To access certain features of our platform, you may be required to create an account. You agree to:

  • Provide accurate and complete information when creating your account
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • Meet the minimum age requirements for integrated platforms (13+ for Discord, platform-specific ages for X and Telegram)
  • Comply with the terms of service of any connected third-party platforms (X, Discord, Telegram)

Third-Party Platform Compliance

When using our integrations with X, Discord, or Telegram, you must also comply with their respective terms of service and community guidelines. Any violation of third-party platform terms may result in termination of your access to related features on our platform.

8. Acceptable Use

You agree not to use the service to:

  • Violate any laws or regulations
  • Infringe on the rights of others
  • Upload malicious code or content
  • Spam or harass other users
  • Attempt to gain unauthorized access to our systems
  • Violate the terms of service, community guidelines, or developer policies of integrated platforms (X, Discord, Telegram)
  • Use our platform to circumvent restrictions or bans on third-party platforms
  • Engage in activities that could harm our compliance with platform developer agreements

9. Platform Developer Compliance

Our platform integrates with third-party services including X, Discord, and Telegram. We are committed to compliance with all applicable developer agreements:

Data Usage Compliance

We use third-party platform data strictly in accordance with developer policies:

  • API data is used solely for our stated application functionality
  • No user profiling or behavioral tracking beyond service provision
  • No sharing of platform data with data brokers or advertising networks
  • No use of platform data for targeted advertising to third parties
  • Compliance with all rate limits, usage quotas, and technical requirements

User Consent and Transparency

We obtain explicit user consent before accessing third-party platform data and maintain transparency about our data usage. Users may revoke platform connections at any time, which will stop our access to their data from those platforms.

10. Intellectual Property

The maikers platform and its original content, features, and functionality are owned by maikers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of content you create and share on our platform.

11. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices.

12. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

13. Disclaimer

The information on this platform is provided on an "as is" basis. To the fullest extent permitted by law, this Company excludes all representations, warranties, conditions and terms whether express or implied.

14. Platform Compliance and Service Availability

Our integrations with third-party platforms are subject to their ongoing availability and our continued compliance with their developer agreements. We reserve the right to:

  • Modify or discontinue integrations based on platform policy changes
  • Suspend features that may compromise our compliance with platform requirements
  • Update our services to maintain compliance with evolving platform standards
  • Terminate accounts that violate platform-specific requirements

Service Limitations

Third-party platform integrations may be subject to rate limits, quotas, or other restrictions imposed by the respective platforms. We cannot guarantee uninterrupted access to third-party platform features and are not liable for platform outages or policy changes beyond our control.

15. Changes to Terms

We reserve the right to modify these terms at any time, including to comply with changes in third-party platform requirements. We will notify users of any material changes through our platform or Discord community. Continued use of the service after changes constitutes acceptance of the new terms.
